The
Australian Labour law is complicated,
the truth is, realy hard to know all rules and because Australia
has many laws to protect the worker, these turned out to be a

Any person may have the ABN number ( Business Number) and
could be a self-employed or an autonomous, even as
temporary resident or international student. The
number can be taken from
Australian
Business Register and get it directly
on the Internet. After opening your busines you just
need to register all expenses and income by month,
and fix your taxes in the end of the financial year
that is in Australia June 30 each year. |
International students and holiday workers are able to
ask for part of the taxes paid when leaving Australia definitively.
Many taxes are taken from the payment such as referring
to superannuation or if returning income taken form
taxes. |
Superannuation is compulsory tax for companies in Australia. It is a
saving deposit for the employer, in which the employee is obliged to deposit a minimum of
9% of the wage under a special account called Super Fund or Superannuation
Fund, plus 3% from the worker. Workers in many cases have the choice which
company they want the money to be deposited and there are many
companies competing
in this market. This account cannot be used until 55 years of
age but the full withdrawal only after 65.
International
Students and temporary workers in Australia can withdraw
the super when leaving Australia for good.
The Superannuation accounts receives annual interests
and the fees and rates varies depending of the kind of
managing fund. There are many incentives to save in
the supper account and it is tax free. |
During the first 3 months workers can be dismissed
without any notice in advance. After that period, the
worker should be
send a notice to be dismissed, but this topic is currently under
review. |
Workers with more than 3 months if they are not
casual, can receive partial holiday payment. |
Contracts can be negotiated privately between the boss
and the worker without a syndicate. That's the rule introduced during the last legislation and many
rules are still under review. Many professional workers
cannot legally act without being register with the Council
and or professional State organization specially related
to dentists,
plumbers, doctors etc. |
On Sundays and holidays, depending in which industry
the work belongs, you may receive an extra
payment of 100% over the normal hour rate up 150%. For
example a person working in a restaurant and another worker
in a restaurant inside a Pub, with pokies machines.
They may receive different
wages because each one belongs to a different
industry. The
restaurant inside the pub pays better than the one in the retail
